Welcome to the website of PDF Agile Software, (“PDF Agile”, “we”, “us” and/or “our”). Data privacy is important and we have prepared this Privacy Policy to explain how we collect, use, protect and disclose data when you use any PDF Agile services which includes this website and any site ("Site(s)"); software provided by PDF Agile ("Software"); or services offered by PDF Agile (collectively, "Services"). "You" refers to you as a user of the Site or Services. This Privacy Policy applies to only those websites and services included within the “Services” and does not apply to any third-party websites and services, even if they are accessible through our Services.

We will only process your personal data in accordance with applicable data protection and privacy laws.

We need certain personal data in order to provide you with access to the Services. If you created a profile, registered an account, downloaded software or provided information to us, you will have been asked to explicitly consent to our End User License Agreement (EULA) and Privacy Policy in order to access our Services, purchase our products and/or view our content. This consent provides us with the legal basis we require under applicable law to process your data. If you do not agree to our use of your personal data in line with this Policy, please do not use our Services.

 

1. Revision to this Privacy Policy

We may update this Privacy Policy to reflect changes to our data practices. If we make any material changes, we will notify you by means of a notice on this Site prior to the change becoming effective. We encourage you to periodically review this page for the latest data on our privacy practices. Please note the effective date listed at the beginning of the Privacy Policy. If we make any material change(s) to the Privacy Policy, we will post a notice on our Site prior to such changes(s) taking effect.

If you disagree with any changes to the Privacy Policy and do not wish to be subject to the revised Privacy Policy, you need to deactivate your account and stop using PDF Agile services.

 

2. Data Collected

We collect information about you in a range of forms, including personal data. As used in this Privacy Policy, “personal data” is as defined in the General Data Protection Regulation EU 2016/679 and any successor legislation; this includes any information which, either alone or in combination with other information we hold about you, identifies you as an individual, including, for example, email address.

2.1 Website Usage Data

If you visit our Sites, we collect Personal Data as follows:

(1) Date and time of the visit and the duration of use of the Site;

(2) Information about how you visit our Sites;

(3) Your operations and clicks to our Sites;

(4) Information about your device (type of device, browser type and version, as well as settings, installed plug-ins, operating system).

 

Purposes of Processing: We process Website Usage Data to allow you to surf the Sites and to ensure their functionality. We also process Website Usage Data to perform analyses on the performance of the Sites, to improve the Sites continuously and correct errors, to ensure IT security and operation of our systems, as well as to prevent or uncover abuse. 

 

2.2 Personal Data:

(1) Account Data: Email.

(2) Transaction Data: Billing information, such as the Type of Services you purchase, the amount you pay, and your order number.

(3) Comment Data;

(4) Content of customer support communications;

(5) Other Data you voluntarily provide to us.

 

Purposes of Processing:

(1) We use Account Data to help you create an account (PDF-Agile ID) and keep a record of your product license (that is, authenticating and periodically verifying your licensing rights in the product for anti-piracy purposes) and to enable the provision of maintenance or support services to you. We will also use this information to provide in-product messaging with information about products, features, or services offered by PDF Agile.

(2) We will use Transaction Data to complete your order, for billing purposes, and for internal accounting and chargeback management purposes.

(3) We will use the comment data to improve its products and provide the consumers and potential consumers with better and transparent information about PDF Agile Services. PDF Agile may use the comments (with your relevant information) you post for marketing purposes in order for others to better understand and use our Services.

(4) In order to provide the Services you purchased to you or perform the contract between you and PDF Agile.

(5) We do not collect or process the data about your payment instruments such as credit card numbers, banking account numbers or PayPal accounts. This information is collected, processed and stored by our qualified payment processors.

(6) From time to time, we may contact our customers directly by email to inform you about upgrades, new products, promotions, or special offers that you told us you were interested in receiving (including our newsletters). The subscription to PDF Agile’s newsletters and the related provision of Personal Data is made on a voluntary basis. If you want to cancel the aforementioned purpose, you can contact us on our Sites or send email to us.

 

2.3 Sensitive Data

PDF Agile does not require or use sensitive data like racial or ethnic origin, political affiliation or opinions, religious or philosophical beliefs, trade union membership, health data, sexual orientation, criminal convictions, or genetic or biometric data. Subject to the following paragraph, we ask that you not send us and/or disclose any such sensitive personal data.

If you send or disclose any sensitive personal data to us when you submit user-generated content to our services, you consent to our processing and use of such sensitive personal data in accordance with this Policy. If you do not consent to our processing and use of such sensitive personal data, you must not submit such user-generated content to our Services.

 

2.4 Document Data

The Sites, Software, and Services provide capabilities to users to upload and manipulate documents. The user is responsible for and owns the content of the documents. PDF Agile does not alter the content of documents. By content, we are referring to text, graphics, and/or images within the document that are human-readable and convey the meaning of the document to a person reading it. Occasionally, we will have to alter the formatting of the document to show it on the Sites (i.e., on Mobile devices) or in the Software, but there will be no material change to the content within the document.

When storing documents on the Sites, Software, and Services, PDF Agile collects the following data:

(1) Document Metadata: Name, size, email address of the user uploading document, metadata about the structure of the document, and standard metadata provided by the standard used to create the document (PDF, DOC, XLS, etc.).

(2) Document Content: The contents of documents stored in the Site, Software, or Services. There are some services, such as converting PDF to other formats, OCR, and converting CAD to PDF, that require the PDF files to be uploaded to the cloud for recognition. The recognition is then passed back to the client-side converter, after which the source files are deleted (no longer than 24 hours), and no user source files are stored.

 

2.5 User Generated Content

You may share personal data with us when you submit user-generated content to our Services, including via our forums and message boards. Please note that any information you post or disclose on our Site will become public information, and will be available to other users of our Site and to the general public. We urge you to be very careful when deciding to disclose your personal data or any other information on our Site. Such personal data and other information will not be private or confidential once it is published on our Site.

 

2.6 Activity Data

Activity Data includes data about how users interact with our Site, Software, or Services. Data in this category includes:

(1) Browser Technologies: Cookies, beacons, tags and scripts

(2) Device Data: Internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system. If printing, we may collect device data about the printer like: Driver, Printer ID, Brand, Make, Model, and other data accessible through the print driver. We may collect this information about you using cookies. Please refer to the sections on Cookies and Pixel Tags below.

(4) Usage Data: We track user activity and collect data about the features you use

(5) Information We Get from Others. We may also get information about you from other sources; for example, if you have agreed to share information with one of our partners or other third parties, we may add this to the information we get from our Services. 

 

2.7 Cookies & Similar Tracking Information 

This article only applies to our website and does not apply to PDF Agile software. There are no advertising or analytic cookies or tracking technology in PDF Agile software.

We collect information about you when you visit our website unless you tell us not to by adjusting your cookie setting. We use such things as cookies and tracking technologies from our analytic service provider tools (e.g., Google Analytics). Information collected includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referrer URL, exit pages, the files viewed on our marketing sites (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data. We use cookies and similar tracking technologies to collect information about your interactions with our Site. 2.8 Use of Data

For the types of processing that are needed to provide the Services, we rely on the necessity of our processing of your information for the performance of the Services (governed by the End User License Agreement) as a legal ground to collect and use your data in accordance with this Privacy Policy. For all other types of processing carried out under this Privacy Policy, we rely on our legitimate interests as a legal ground to collect and use your data in such ways.

PDF Agile uses data provided through the use of our Sites, Software, and Services to provide services for which PDF Agile was engaged. The data may be used for a variety of functions, including:

(1) Provide, monitor, maintain and improve the Software, Site and Services

(2) Register for and enable access to the Software, Site and Services

(3) Purchase services and contact you in case a purchase request cannot be fulfilled

(4) Manage documents (including upload, download, convert, and edit)

(5) Deliver the services you request

(6) With your consent, personalize and customize the Site and Services by improving content, features, and/or advertisements based on your interests and preferences

(7) Send push notifications that update you on activities initiated within the Site and Services

(8) Send you related data (including confirmation of service requests and/or purchases)

(9) Provide customer support (comments, questions, and requests for support along with support responses)

(10) With your consent, provide data about services (surveys, offers, promotions, contests, events, customer testimonials, case studies, and data about PDF Agile)

(11) Monitor and analyze trends in connection with the Site and Services for marketing and advertising purposes

(12) Investigate potential illegal activities (fraudulent transactions, unauthorized access, and/or other illegal activities)

(13) With your consent, link or combine with other data from 3rd Parties to understand your needs and preferences

(14) Diagnose unexpected issues that occur within the Site and Services

 

3. Legal Basis for Processing

When processing your Personal Data, we usually rely on your consent. However, under some circumstances, we may process your Personal Data without getting your prior consent, such circumstances may include: (a) processing is necessary for the performance of a contract to which you(the data subject) are party or in order to take steps at the request of the data subject prior to entering into a contract; (b) processing is necessary for compliance with a legal obligation to which PDF Agile (the controller) is subject; (c) processing is necessary in order to protect the vital interests of the data subject or of another natural person; (d) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller; (e) processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of Personal Data, in particular where the data subject is a child.

If we rely on your consent to process your Personal Data, you have the right to withdraw your consent at any time.

 

4. Data Transfer

Your information, including personal data that we collect from you, may be processed and transferred within and to the United States and other countries and territories that may have different privacy laws from your country of residence. PDF Agile is compliant with the EU General Data Protection Regulation (GDPR).

PDF Agile takes data privacy seriously and monitors the regulatory landscape with regard to data privacy. As new regulations evolve, PDF Agile will evaluate those regulations and, in good faith, evolve our Data Privacy procedures appropriately.

 

5. Sharing, Disclosure and Transfer

We will not share any information that we have collected from or about you except as described below, and we will share only necessary information on a minimum basis:

5.3 Information Disclosed in Connection with Business Transactions. Information that we collect from our users is considered to be our business assets. Thus, if we are engaged with a third party in a transaction such as a merger, acquisition or sale of assets or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your information, may be disclosed or transferred to a third party acquirer in connection with such transaction. You will be notified via email (sent to the email address specified in your account) or prominent notice on our Site of any such change in ownership or control that affects your personal data.

5.4 Information Required by Law. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims legal process (including subpoenas); (ii) to protect our property, rights and safety and the property, rights and safety of a third party or the public in general as required or permitted by law; and (iii) to stop any activity that we consider illegal, unethical or legally actionable. However, we may push back when a legal request appears to be overly broad or does not follow the correct process.

5.5 Aggregated and Anonymized Data: We also share aggregated and anonymized data with partners that do not directly identify individuals. We may create anonymous data from the personal data we receive about you and other individuals whose personal data we collect. Anonymous data might include analytics information and information collected by us using cookies.  We make personal data into anonymous data by excluding information (such as your name) that makes the data personally identifiable to you.  We use this anonymous data to analyze usage patterns in order to make improvements to our Services.

 

6. The Security and Storage of Your Information

6.1 We take all reasonable administrative, physical and electronic measures to protect the information that we collect from or about you from unauthorized access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. We work hard to protect you and PDF Agile from unauthorized access, alteration, disclosure, or destruction of information we hold, including: (i) we use encryption to keep your data private while in transit; (ii) we restrict access to personal information to  PDF Agile employees, contractors, and agents who need that information in order to process it. Anyone with this access is subject to contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations. However, please note that no transmission over the Internet is completely secure or error-free and that the information security policies, rules and technical measures utilized and maintained by us may be subject to compromise.

6.2 We will retain your information for the period strictly necessary for fulfilling the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law. For example, we retain your account information for as long as your account is active or as needed to provide you with Products or Services you have requested or authorized, including maintaining and improving the performance of the Products or Services and protecting system security. We also retain personal data as needed to maintain appropriate business and financial records, protect our legal interests, resolve disputes, or comply with legal or regulatory requirements.

 

7. Consent and Opt-out

7.1 Site Documents

This article only applies to our website and does not apply to PDF Agile software.

PDF Agile provides promotional sites (commonly referred to the "conversion sites") that provide services to convert documents from one format to another. By using the conversion sites, you allow PDF Agile temporarily to store, retain, and use personal data, document data, and document metadata per the 'Use of Data' section above. If you do not wish to provide this personal data, document data, and document metadata, then refrain from using the conversion sites.

7.2 Services and Software Documents

Outside of the conversion sites (above), you may delete your documents at any time from within the Services or Software via the User Interface.

7.3 Account Data

We will retain your Personal, Document, and Activity Data for as long as your account is active or as needed to provide you Services. If you wish to cancel your account or request that we no longer use your personal data to provide you with Services, please contact support@pdfagile.com. However, PDF Agile will retain and use your Personal, Document, and Activity Data as necessary to comply with our legal or other obligations, resolve disputes, and enforce our rights and agreements. PDF Agile reserves the right to delete any data for inactive accounts.

7.4 Customer Testimonials

We may post customer testimonials/comments/reviews on our Site which may contain personal data. We obtain the customer's consent, prior to posting the testimonial, to post the customer’s name along with the customer’s testimonial. If you would like to have us remove any of your comments, please contact us.

 

8. Children's Privacy

PDF Agile's Sites and services are not intended for use by children under the age of 16, and we do not intentionally collect any information from users under the age of 16. If you do not meet the applicable age requirements, please do not use those Sites and services. If a parent or guardian becomes aware that their child has provided PDF Agile with Personal Data or that we have otherwise inadvertently collected this information, contact us at support@pdfagile.com, so that we may delete the information from our servers.

 

9. Data Subject's Rights

PDF Agile takes privacy seriously. If you have any concerns regarding our handling of your Personal, Sensitive, or Document Data, we encourage you to contact us (details below in the 'Contact Us' section). Additionally, We provide the following rights to protect your information for our global customers:

(1) Right of Access. You have the right to receive information about your personal data processed by us upon request.

(2) Right to Rectification. You have the right to correct or amend your information if it is incorrect, inaccurate or incomplete.

(3) Right to Withdraw Your Consent. You have the right to withdraw the consent given to us at any time. As a result, we are no longer allowed to continue the processing based on this consent in the future. This does not affect the legality of the processing carried out on the basis of the consent up to the point of withdrawal.

(4) Right to Erasure. You have the right to obtain from us, under the following conditions, the deletion of your information:

A. the respective processing purpose has been achieved;

B. we have unlawfully processed your information;

C. you have withdrawn your consent without another legal basis applying to the data processing;

D. you have successfully objected to the data processing;

E. in cases where there is an obligation to delete information on the basis of EU law or the law of an EU member state to which we are subject.

We may provide other rights for residents of some countries/territories subject to the locally applicable data protection law. We respect and constantly take multiple practices to protect your information no matter where you live.

10. Additional Privacy Information for EEA Residents

In this section, we provide additional information to European Economic Area (EEA) residents, as required under EU privacy laws, including the General Data Protection Regulation (“GDPR”).

(1) Legal Basis of Processing Information

We process information if one of the following applies

A. Necessary for entry into, or performance of, any contract(s) with you (Art 6(1)(b) of the GDPR).

B. Necessary for the legitimate interests of us, where these are not overridden by your interests or fundamental rights and freedoms (Art 6(1)(f) of the GDPR).

C. Necessary for compliance with a legal obligation to which we are subject (Art 6(1)(c) of the GDPR).

D. In limited circumstances and to the extent the legal bases for processing set out above do not apply, processed with your consent (Art 6(1)(a) of the GDPR).

(2) GDPR Rights 

A. The right of access.

The User has the right to obtain access to its Personal Data (if PDF Agile is processing it), and other certain information (similar to that provided in this privacy policy).

B. The right to rectification.

The User is entitled to have its Personal Data corrected if it's inaccurate or incomplete.

C. The right to erasure.

This right enables the User to request the deletion or removal of its Personal Data where there’s no compelling reason for PDF Agile to keep using it. This is not a general right to erasure; there are exceptions.

The right to restrict processing

Under certain circumstances, the User has the right to ‘block’ or suppress further use of its Personal Data.

E. The right to data portability

The User has the right to receive its Personal Data provided to PDF Agile in a structured, commonly used and machine-readable format and has the right to transmit those data to another controller.

F. The right to object to processing

The User has the right to object, on grounds relating to its particular situation, at any time, to the processing of its Personal Data.

G. The right to object to Automated Decision-Making

The User has the right to object to any decision made solely through automated processing (such as algorithmic analysis) that significantly impacts their rights and to request human intervention in such decision-making process.

To ensure security, when you exercise the rights mentioned above, you may be required to provide a written request or otherwise demonstrate your identity. We will process your request within the statutory time limits after verifying your identity.

 

11. Additional Privacy Information for California Residents

In this section, we provide additional information to California residents, as required under California privacy laws, including the California Consumer Privacy Act (“CCPA”). This section does not apply to publicly available information lawfully made available by state or federal government records, de-identified information, aggregate consumer information, or other personal information that is exempt under the CCPA (such as information covered by the Health Insurance Portability and Accountability Act).

(1) While our collection, use and disclosure of personal information vary based upon our relationship and interactions with you, in this section we describe, generally, how we have collected and disclosed personal information about California residents in the prior 12 months (from the Last Updated date above), and the rights California residents have under the CCPA regarding this personal information.

(2) CCPA Rights 

In general, California residents have the following rights with respect to their personal information:

1. Do-not-sell (opt-out): to opt out of our sale of their personal information, including those we have actual knowledge of who are younger than 16.

2. Right of deletion: to request deletion of the personal information that we have collected about them and to have such personal information deleted, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies.

3. Right to know: with respect to the personal information we have collected about them in the prior 12 months, to require that we disclose the following to them (up to twice per year and subject to certain exemptions):

A. categories of personal information collected.

B. categories of sources of personal information.

C. categories of personal information about them we have disclosed for a business purpose or sold.

D. categories of third parties to whom we have sold or disclosed for a business purpose their personal information

E. the business or commercial purposes for collecting or selling their personal information.

F. a copy of the specific pieces of personal information we have collected about them.

4. Right to non-discrimination: the right not to be subject to discriminatory treatment for exercising their rights under the CCPA.

(3) Submitting CCPA

California residents may submit CCPA requests to exercise their “Right to know (access)” and “Right of deletion” to support@pdfagile.com.

When you submit a request to know or a request to delete, we will take steps to verify your request by matching the information provided by you with the information we have in our records. If we are unable to adequately verify a request, we will notify the requestor. Authorized agents may initiate a request on behalf of another individual by contacting us by email; authorized agents will be required to provide proof of their authorization, and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
